•Preamble
These terms and conditions are concluded between, on the one hand, the company Planète Légende, owner of the site www.planetelegendaire.com registered with the Poitiers Trade and Companies Register under the SIRET number 514 548 486 00034, and on the other hand, people wishing to make a purchase via the Planete Legendaire website (www.planetelegendaire.com) hereinafter referred to as "the User".
The parties agree that their relationship is governed exclusively by this Agreement, excluding any terms previously available on the Site.
If a condition were to be missing, it would be considered to be governed by the practices in force in the distance selling sector whose companies have their registered office in France.
The site www.planetelegendaire.com is hosted by the company OVH (www.ovh.com).
•Acceptance
The mere fact of ordering goods on the site www.planetelegendaire.com entails the total and unreserved acceptance of our General Terms and Conditions of Sale.
The user acknowledges that he or she has read and approved each of the clauses constituting these General Terms and Conditions of Sale.
The acceptance of the "user" is materialized by the electronic signature made by 'validation and payment click' by PayPal, or by sending a French bank check, transfer or money order for the amount of the order.
"The User" further declares that he or she has the capacity to enter into this Agreement.
•Object
These terms and conditions are intended to define the terms of sale between Planete Légende and the user: from the order to the services, including payment and delivery. They regulate all the steps necessary for the placing of the order and ensure the follow-up of this order between the contracting parties.
1. The order
The user places his order online from the site's references. The order can only be registered on the site if the user has clearly identified himself by his email address and password after creating his customer account.
The acceptance of the order is materialized by an order number communicated with the details by email to the customer.
Any order implies acceptance of the prices and descriptions of the products available for sale.
The company Planete Legendaire undertakes to honour the orders received on the website only within the limit of available stocks of the products. If the product is not available, planete legendaire undertakes to inform the user as soon as possible and to reimburse the missing reference by PayPal or cheque within 72 hours.
Planete Legendaire reserves the right to cancel the order of a customer with whom there is a dispute relating to the payment of a previous order.
2- Prices
The prices shown on the website are indicated in euros (free of VAT in accordance with Article 293b of the General Tax Code), excluding delivery costs. They are likely to vary, in particular in the event of a fluctuation in the exchange rate of the currency against the euro. However, the prices appearing on your order after it has been validated and registered are firm and definitive: if the prices drop a few days after the order, we will not be able to compensate you for the difference; If prices increase, we have undertaken to deliver to you at the price set on the day of the order. The amount of the delivery costs is calculated automatically according to each order; It appears on the summary of your order, before final registration. If you are a customer outside the European Union or in the French Overseas Departments and Territories, the invoice will also be issued free of VAT. Any order delivered outside of mainland France may be subject to any local taxes, customs duties, dock dues and customs clearance fees at the time of delivery. Their payment is at your expense and is your responsibility. Check with the competent authorities of the country of delivery. However, the goods purchased by professionals are purchased at the price agreed at the time of the order, within the limit of the option period and the general economic conditions (taxes, exchange rates, etc.) at the time of delivery.
3. Delivery
The user has the choice of having the following delivered:

- to another address other than the billing address
Our deliveries are made by La Poste or by Mondial Relay (Available only for France and Belgium)
Delivery with Swiss Post :
By means of the Colissimo Tracking service, or by Priority Postal Parcel for international use.
Planete Legendaire is committed to making deliveries of the items ordered as soon as possible. The average delivery time is 3 to 4 working days for France, 4 to 7 days for Europe and on a case-by-case basis for abroad, upon receipt of payment. Exceeding them cannot result in the cancellation of the order or compensation for the Client.
Legendary Planet cannot be held responsible for the consequences of a delay in delivery by its carrier.
In order to track your delivery, we will provide you with a tracking number on the day of departure of the parcel to be entered from the next day on the carrier's website. This site will tell you in real time the position of your parcel in the circuit:

In the event of delivery to a country other than Metropolitan France, you are the importer of the products ordered. Customs taxes and formalities are the sole responsibility of the Client. The Client is solely responsible for verifying the possibilities of importing the products ordered with regard to the law of the territory of the country of delivery.
For deliveries outside the EEC and DOM TOM, any customs and other import duties may be payable. These sums will be entirely at your expense and responsible both in terms of declarations and payments to the local authorities.

Delivery by Mondial Relay:
Using the Mondial Relay service, only available for France and Belgium, Planete Legendaire is committed to making deliveries of the items ordered as soon as possible. The average delivery time is 4 to 5 working days for France and Belgium, upon receipt of payment. Exceeding them cannot result in the cancellation of the order or compensation for the Client.
Legendary Planet cannot be held responsible for the consequences of a delay in delivery by its carrier.

4. Returns
Planete Legendaire undertakes to refund or exchange non-compliant products.
To do this, you have a period of 48 hours, upon receipt of the package, to send us an email reporting the problem in great detail (with a digital photo as far as possible).
Upon receipt of the product, if you notice that the packaging is damaged, we undertake to check the product immediately. Notify the damage in writing on the delivery note (La Poste) before receipt.
You can only return the goods to us after our written agreement. You will be reimbursed for the return shipping costs charged. This return must be made within 14 days of the delivery of the order.
The refund will be made by PayPal or bank check addressed to the name of the customer who placed the order and to the billing address.
5. Right of withdrawal
You have seven (7) business days to return, at your own expense, products that are not suitable for you. This period runs from the day you receive your package.
You will be reimbursed for the sums paid, in return for the return of the goods at your expense within seven (7) days of receipt by Planete Legendaire, and provided that the product is in its original condition and packaging.
6. Payment methods
The user has the choice to pay for his purchases:
- secure online ordering by PayPal (Carte Bleue, Visa, Mastercard, Eurocard)
- by bank transfer, once your order has been placed, we will send you by email our bank details so that you can make the transfer
- by bank cheque in euros and from a French bank, by printing the order form and sending everything by post. The cheque will be sent to Planete Legendaire – Résidence Morphée Appt 63, 2 avenue Clément Ader 86360 Chasseneuil du Poitou, and made payable to Planete Legendaire.
The Client guarantees the company Planete Legendaire that he has the necessary authorisations to use the payment method by PayPal or Skrill, when validating the order form.
Data relating to online payment is not held or stored by Planete Legendaire at the time of payment and after payment.
All orders are payable in euros.
Any change in the applicable rate may be reflected in the prices of the products. After this date, they are subject to change at any time.
7. Default
In the event of total non-payment of the payment, Planete Legendaire reserves the right to give formal notice or summon the customer to court and the costs of the procedure will be borne by the customer.
Legendary Planet reserves the right to claim any work and item in the event of non-payment.
The customer undertakes to return any product not paid for in full to Atelier de France, all costs at its expense, upon first request from Planete Legendaire.
8. Signatures and Evidence
Responsibilities
The figures for sale on the Legendary Planet website are not suitable for children under 14 years of age. Some models may contain corners or dangerous aspects (weight and others...)
For all stages of access to the site, the ordering process, delivery or subsequent services, Planete Legendaire has only an obligation of means. Planete Legendaire cannot be held liable for any inconvenience or damage inherent in the use of the Internet, in particular a break in service, an external intrusion or the presence of computer viruses, or any event qualified as force majeure, in accordance with case law.
Personal Data
Planete Legendaire reserves the right to collect data on the user, in particular through the use of cookies.
Intellectual property
All elements of the Planete Légende website, whether visual or audio, including technology and content are protected by copyright, trademarks or patents.
They are the exclusive property of the company Planete Legendaire. The user who has a website on a personal basis and who wishes to place, for personal use, on his site a simple link referring directly to the "home page" of the planetelegendaire.com site, must make a request to the company Planete Legendaire.
Entirety
In the event that one of the clauses of this contract is null and void by a change in legislation, regulations or by a court decision, this shall in no way affect the validity of and compliance with these general terms and conditions of sale.
Duration
These conditions apply for the entire duration of the online publication of the services offered by the company PLANETE LEGENDAIRE.
Shipping costs are invoiced at the rate listed on the order form. They are calculated according to the weight of the cumulative amount of each item, and correspond to the price brackets communicated by post for Colissimo Suivi.
In accordance with the law of 12 May 1980, Planete Legendaire retains ownership of the product until the full payment of the price by the customer.
9. Payment
The price of the items ordered is payable in full to Planete Legendaire as soon as the order is confirmed on the site, according to one of the following payment methods:
- by PayPal
- by cheque
- by bank transfer
10. Right of withdrawal
Under the conditions provided for in Article L121-16 of the Consumer Code and in the context of distance selling, the buyer has a withdrawal period of 7 clear days from the delivery of his goods, which will be reimbursed against return of the products delivered. The buyer must return the goods in their original condition and packaging. The return of the goods is made at the buyer's expense, risk and peril.
11. Litigation
Complaints or disputes will always be received with attentive benevolence, good faith being always presumed in the person who takes the trouble to explain his situations.

12. Intellectual Property
By connecting to the website created by Planete Legendaire, which is the holder of all the intellectual property rights relating thereto, the customer is prohibited from copying or downloading all or part of its content, except with the prior and express authorisation of Planete Legendaire.
